| jeff 6/8/2009 6:04:00 PM | Since starting HANA we've been pushing the industry for improvement in 5 areas. In no particular order of importance they are: 1. Availability of Track Signals 2. Takeout 3. Drugs 4. Pool Integrity 5. Quality of the Product Recent events... short fields everywhere, certain track signals STILL not available to all ADWs, trainers who cheat, and 3 separate publicly known instances of past posting happening within the past few weeks have left many players with a less than favorable perception about the state of the game. Well I've got some good news to report if you are a California resident. The CHRB recently voted to reverse its long standing policy banning rebates on California signals and to California residents. After a 45 day waiting period the CHRB reaffirmed that position at its June 5, 2009 meeting. Here's what the CHRB recently emailed to me on the subject of rebates: The Board repealed a rule that had placed restrictions on the state’s racetracks and simulcast associations from doing business with off-track betting facilities offering rebates to persons wagering on horse races. Given that rebate restrictions might discourage wagering on California races, the Board eliminated the prohibition, freeing all locations to offer rebates to customers. So I asked CHRB Public Information Officer Mike Marten exactly what that meant: Question: Does this mean that ADWs such as YouBet, TVG, ExpressBet, Premier Turf Club, RGS, Bet America, LinkToBet, TwinSpires, etc. are now able to offer - should they desire to do so: 1. Rebates to out of state residents wagering on California track signals? 2. Rebates to CALIFORNIA RESIDENTS wagering on California track signals? 3. Rebates to CALIFORNIA RESIDENTS wagering on non California track signals? Can you answer each of the above three items separately? Sincerely, Jeff Platt President, HANA To which Mike Marten replied to me in an email earlier today: Jeff: I verified with our policy and regulations department that the answer to all of three questions is yes. Here is what they said: The answer is yes to all of his questions. The repeal of the rebate rule essentially allows the industry to offer rebates. The prohibition in California regarding rebates is no more. Reminder, the proposal will need to be submitted to the OAL for determination before the repeal becomes effective. The OAL has 30 days upon receipt of the rulemaking file to make a determination. The repeal becomes effective 30 days after filing with the Secretary of State. Mike IMHO the game's 20 percent plus blended takeouts depress player demand for the product. I keep pushing for rebates as a form of reduced takeout because experience is showing that it's easier to get rebates approved in racing jurisdictions than it is to get track operators to agree to takeout reductions. I have to admit that I was cautiously optimistic about what HANA could accomplish and the about the pace of what they could accomplish when I joined early-on. The organization has surpassed all of my expectations with the track ratings, the reception at Keeneland, your appearance on TVG, and now this positive move by what many considered to be an immovable object, the CHRB. As long as I have your attention, can you tell me why the Cal tracks have such small fields (other than the unfavorable surface)? Look at what SoCal and NoCal have in terms of large geographies and minimal racetrack competition. Compare their common 4 to 6 horse fields to somewhere like Evangeline that routinely has 12-horse fields. Evangeline has competition relatively close by with Louisiana Downs and other southern tracks. Thanks, and again, great work Mr. HANA CEO. Dale

| mikejlb 9/27/2009 6:55:06 PM | I believe CA can't compete with tracks that have slots. Our Governor seems to be very protective (invested?) over the Indian casinos.

However I believe that the State of California has for years literally had the wool pulled over its eyes by the tracks and horsemen of California. I recently posted about this over at PA. Update on Rebates in CA http://www.paceadvantage.com/forum/showthread.php?t=62003 Go over to the HANA Forum at PA and give this a read. Players everywhere should be up in arms over this. Yet in the same forum, the thread about a little HANA bashing by a few posters over at the DMFF is drawing nearly 4 times as many posts as the CA Rebate thread. | mikejlb 9/30/2009 7:39:27 PM | I just read one PA thread that started off with negative HANA remarks. Guys like that aren't bashing you, Jeff. The bashing is against all of us that want a voice that will be heard. Other posters very effectively made the basher look like a fool. Be happy that so many guys respect what you're doing!

If players will bet their conscience maybe we can send a very clear message to racing's decision makers: An Open Letter to Los Alamitos Horseplayers Last week HANA Pres Jeff Platt spoke at a CHRB meeting in opposition to a proposed 2% takeout increase at Los Alamitos. The CHRB Board, despite the evidence presented that an increase in takeout rates would have a negative impact on handle and revenues, decided to institute the raise. They also included a review process, where by the CHRB would from time to time review Los Alamitos handle numbers between now and Sept 8th, 2010, in order to monitor the effect of this takeout increase on handle. If the handle numbers come back weak, and show that horseplayers are reacting negatively to this takeout increase, there is a high likelihood it will be rescinded. If the handle numbers come back unchanged, there is a high likelihood the takeout increase will be made permanent. It is also likely, in our opinion, that if Los Alamitos handle is strong, that other California tracks will follow suit with takeout raises of their own. We know this would have a very negative effect on you, as a horseplayer, and in return on California Racing as a whole. You, as a Los Alamitos bettor, have a very big say in all of this. Each dollar bet at Los Alamitos is a vote for making the takeout increase permanent, and a vote towards seeing higher takeouts across California. Each dollar withheld from Los Alamitos is a vote towards rescinding this takeout increase, and discrediting the notion that racing's revenue problems can be solved by simply raising the price of an already overpriced product. You are in the enviable position to have a direct and measurable impact on the future of California racing, and to make a statement on behalf of horseplayers everywhere. We ask you to consider these facts, and we trust that your actions and decisions will help to bring about a better and brighter future for this game.
